Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and Trevy LLC, a Florida limited liability company ("Trevy," "we," "us," or "our"). By accessing or using the Trevy platform, creating an account, or clicking "I agree," you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not have such authority, or if you do not agree with these Terms, you must not accept these Terms and may not use the Services.
You must be at least 18 years of age to use Trevy. By using the Services, you represent and warrant that you meet this age requirement.
2. Description of Services
Trevy provides an AI-powered assistant platform designed for real estate professionals ("Services"). The Services include, but are not limited to:
- AI conversational assistant for CRM management, lead organization, and workflow automation
- AI-generated personalized email composition and delivery
- Comparative Market Analysis (CMA), property search, and market data retrieval
- Rule-based pipeline automation ("Sweeps")
- Email integration with Gmail and Microsoft Outlook for reading, composing, and managing email
- Calendar integration for viewing and creating events
- Customer data platform (CDP) for lead activity tracking, behavioral profiling, and engagement analytics
- Email engagement tracking (opens, clicks, property link identification)
- Team management with seat-based access and billing
The Services utilize third-party artificial intelligence models, including Anthropic's Claude, to process your requests. Trevy does not guarantee the accuracy, completeness, or reliability of AI-generated outputs.
3. Account Registration and Security
To use the Services, you must create an account and provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Trevy at support@trevy.io of any unauthorized use of your account or any other breach of security.
Team accounts allow an account owner ("Team Leader") to invite additional users ("Team Members") by assigning seats. Team Members must register using the email address associated with their Follow Up Boss profile. The Team Leader is responsible for all activity by Team Members and for managing seats, billing, and integrations.
4. Subscription, Billing, and Payment
The Services are offered on a subscription basis. By subscribing to a plan, you authorize Trevy to charge your designated payment method on a recurring basis (monthly or annually, depending on your selection) until you cancel your subscription.
- Plans. Trevy offers multiple subscription tiers (Agent, Team, Business), each with different seat allocations, AI email credit allocances, and feature access. Current pricing is available at trevy.io/pricing.
- Seat Changes. Additional seats may be added at any time and are prorated for the remainder of the current billing period. Seat removals take effect at the end of the current billing period.
- Plan Changes. Upgrades are effective immediately and prorated. Downgrades take effect at the end of the current billing period. No refunds are issued for downgrades.
- Email Credit Packs. Additional AI email credits may be purchased as one-time or recurring add-ons. One-time credits do not expire and persist until used. Recurring credits refresh each billing cycle and are non-refundable.
- Cancellation. You may cancel your subscription at any time through Settings. Upon cancellation, your access continues until the end of the current billing period. No refunds are issued for partial billing periods.
- Price Changes. Trevy reserves the right to modify pricing upon 30 days' prior notice. Price changes will not affect your current billing period.
All fees are stated and payable in United States dollars. You are responsible for all applicable taxes. If your payment method fails, we may suspend access to the Services until payment is resolved.
5. Customer Data
As between you and Trevy, you retain all right, title, and interest in and to any data, content, or information you provide, upload, or make available through the Services ("Customer Data"), including but not limited to CRM data, contacts, emails, property information, and conversation transcripts.
You grant Trevy a limited, non-exclusive, worldwide license to use, process, store, and transmit Customer Data solely to the extent necessary to provide and improve the Services. This license terminates when your account is deleted.
Trevy does not use Customer Data to train artificial intelligence or machine learning models. Customer Data is not sold, rented, or shared with third parties for their independent use.
You represent and warrant that you have all necessary rights, consents, and permissions to provide Customer Data to Trevy and to authorize its processing as described in these Terms and our Privacy Policy. You are solely responsible for the accuracy and legality of Customer Data.
6. AI-Generated Content
The Services utilize artificial intelligence to generate emails, market analyses, property recommendations, lead management suggestions, and other content ("AI Output"). AI Output is provided for informational and assistive purposes only.
YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, VERIFYING, AND APPROVING ALL AI OUTPUT BEFORE RELYING ON IT OR TRANSMITTING IT TO THIRD PARTIES. Without limiting the foregoing, you are responsible for:
- Reviewing all AI-generated emails before sending
- Verifying the accuracy of property data, pricing, valuations, and market information
- Ensuring compliance with all applicable laws and regulations, including but not limited to the Fair Housing Act, state real estate licensing laws, CAN-SPAM Act, TCPA, and state advertising regulations
- Obtaining all necessary consents before sending communications to leads or clients
Trevy makes no representations or warranties regarding the accuracy, completeness, legal sufficiency, or fitness for any particular purpose of AI Output.
7. Third-Party Integrations
The Services integrate with third-party platforms including, but not limited to, Follow Up Boss, Google (Gmail, Google Calendar), Microsoft (Outlook, Microsoft Calendar), Stripe, Zillow, RentCast, WalkScore, and the U.S. Census Bureau. Your use of these integrations is subject to the respective third-party terms of service and privacy policies.
Trevy is not responsible for the availability, accuracy, or performance of third-party services. You may disconnect any integration at any time through Settings.
When you connect your Follow Up Boss account, you authorize Trevy to access and modify your CRM data on your behalf. Your FUB API key is encrypted at rest and is never exposed in logs, responses, or to other users.
8. Acceptable Use
You agree not to use the Services to:
- Send spam, bulk unsolicited communications, or engage in any form of harassment
- Violate any applicable law, regulation, or third-party right, including but not limited to the Fair Housing Act, CAN-SPAM Act, TCPA, CCPA, and state real estate regulations
- Upload, transmit, or store any content that is unlawful, defamatory, obscene, or infringes on intellectual property rights
- Attempt to reverse engineer, decompile, disassemble, or extract source code from the platform
- Interfere with or disrupt the integrity or performance of the Services
- Access the Services through automated means (bots, scrapers) except through our published APIs
- Share account credentials or allow unauthorized third parties to access the Services
- Use the Services in a manner that exceeds reasonable usage or degrades service quality for other users
Trevy reserves the right to suspend or terminate accounts that violate these provisions, with or without notice.
9. Intellectual Property
The Services, including all software, algorithms, user interfaces, designs, text, graphics, and other content provided by Trevy (excluding Customer Data), are owned by or licensed to Trevy and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use Trevy's name, trademarks, logos, or other brand features without our prior written consent.
If you provide feedback, suggestions, or recommendations regarding the Services ("Feedback"), you grant Trevy a perpetual, irrevocable, non-exclusive, royalty-free license to use, modify, and incorporate such Feedback into the Services without obligation to you.
10. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through Settings. Trevy may suspend or terminate your access to the Services for cause, including but not limited to breach of these Terms, non-payment, or conduct that we reasonably believe is harmful to other users or to Trevy.
Upon termination, your right to use the Services ceases immediately (or at the end of your billing period, in the case of voluntary cancellation). Your Customer Data will be retained for 30 days following termination, after which it will be permanently deleted. You may request a data export during this 30-day period by contacting support@trevy.io.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TREVY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, TREVY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; THAT ANY DEFECTS WILL BE CORRECTED; OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR FIT FOR ANY PARTICULAR PURPOSE. YOU USE THE SERVICES AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TREVY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, LOST BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF TREVY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TREVY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO TREVY DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Trevy's liability shall be limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Trevy LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any rights of a third party; or (e) any Customer Data you provide through the Services.
14. Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida, and the parties hereby consent to personal jurisdiction and venue therein.
15. Modifications
Trevy reserves the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by email or through the platform. Your continued use of the Services after such changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Services and cancel your subscription.
16. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Trevy regarding the Services and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. The failure of Trevy to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms without Trevy's prior written consent. Trevy may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.
